Unsafe Cladding: What Leaseholders Do Not Have to Pay

If you have a qualifying lease in a relevant building with unsafe cladding, your building owner must cover all cladding remediation costs and you cannot be charged for fixing or replacing the cladding. Non-cladding fixes and waking watch costs can be passed on only up to a cap. Check your position on GOV.UK.

Your Rights

What the rules say, with a link to the official source for each.

What You Do Not Pay

  • Cladding

If you have a qualifying lease and live in a relevant building with unsafe cladding, your building owner must cover all cladding remediation costs. This also applies to non-qualifying leases where the building owner is linked to the original developer. You are also protected from legal or professional costs for your building owner pursuing remediation, unless residents manage the building and apply for a remediation contribution order. source

  • Tests

Protected if, on 14 February 2022, the building owner was or was linked to the developer, or your lease was worth less than £325,000 in Greater London or less than £175,000 elsewhere in England, or the landlord group has a net worth of at least £2 million per relevant building. Invoices issued before 28 June 2022 cannot be demanded for these reasons. Use the "Check building safety costs" service on GOV.UK. Your landlord must provide a landlord certificate. source

Who Pays

  • Funding

Grant funding is available for removing unsafe cladding in buildings above 18 metres, and the Building Safety Fund and Cladding Safety Scheme for buildings between 11 and 18 metres. Over 55 developers pledged to fix life-critical fire safety defects in buildings above 11 metres they helped develop or refurbish in the past 30 years. Buildings below 11 metres or five storeys are not relevant buildings and costs follow your lease. Money paid since 28 June 2017 will not be refunded but counts toward the cap on non-cladding costs. source
